1. Agreement to These Terms

By accessing or using www.mulli.ca(the "Site"), placing an order, making a reservation or deposit, downloading or using the Mulli companion application (the "App"), or purchasing any Mulli product or subscription, you agree to be bound by these Terms & Conditions ("Terms"). By placing an order or reservation, you confirm that you have read, understood, and agree to these Terms in full. If you do not agree to these Terms, do not use the Site or place an order.

These Terms form a legally binding agreement between you and Mulli Swing Solutions ("Mulli," "we," "us," or "our"), a company operating in New Brunswick, Canada.

We may update these Terms from time to time. The "Last Updated" date above reflects the most recent revision. Continued use of the Site or our products after changes are posted constitutes acceptance of the revised Terms. Material changes affecting existing reservations or subscriptions will be communicated by email where reasonably possible.

2. Eligibility

You must be at least 18 years of age, or the age of majority in your province, territory, or jurisdiction of residence, to place an order or create an account. By using the Site, you represent that you meet this requirement and that all information you provide is accurate and complete.

3. Reservations, Deposits & Pre-Orders

Mulli currently accepts reservations for the Mulli Smart Grip ahead of its commercial launch. The following terms apply to all reservations, deposits, and pre-orders:

  • (a) Nature of a ReservationA reservation deposit (currently $10 CAD per unit) secures your place in the launch queue and locks in the discounted launch price of $250 CAD per unit, which includes 3 months of access to the individual App subscription. A reservation is not a completed purchase of the product. The remaining balance will be charged or invoiced prior to shipment, at which time you will be asked to confirm your order and shipping details.
  • (b) Cancellation & Refund of DepositsDeposits and pre-orders may be cancelled at any time prior to the final balance payment, for any reason, for a full refund of the deposit amount. To cancel, contact us through the Site's contact page or the email address provided in your reservation confirmation. Refunds are issued to the original payment method and may take 5–10 business days to appear depending on your financial institution.
  • (c) Estimated Shipping DatesAll launch and shipping dates (currently estimated as Q4 2026) are good-faith estimates only and do not constitute a guarantee. Hardware development, manufacturing, certification, and logistics timelines may shift. We will communicate material delays to reservation holders. A delay in the estimated shipping date does not entitle you to compensation beyond your right to cancel and receive a full refund of amounts paid.
  • (d) Product ChangesBecause the Mulli Smart Grip is in active development and pilot testing, final specifications, features, materials, App functionality, and packaging may differ from images, renders, descriptions, or prototypes shown on the Site. We reserve the right to make improvements and modifications. If a change materially reduces the core functionality described at the time of your reservation, you may cancel for a full refund.
  • (e) No Resale GuaranteeReservations are personal to you and may not be sold, transferred, or assigned without our written consent.
  • (f) Right to Refuse or CancelWe reserve the right to limit reservation quantities, refuse or cancel any reservation or order at our discretion (including suspected fraud, pricing or listing errors, or address regions we cannot serve), in which case any amounts paid will be fully refunded.

4. Orders, Pricing & Payment

  • (a) PricesPrices are displayed in CAD or USD as selected on the Site. Prices do not include applicable taxes, duties, customs fees, or shipping charges unless expressly stated. You are responsible for any import duties or taxes applicable in your jurisdiction.
  • (b) Pricing ErrorsWhile we strive for accuracy, errors in pricing or product information may occur. We reserve the right to correct errors and to cancel orders placed at an incorrect price, with a full refund of amounts paid.
  • (c) PaymentPayment is processed through third-party payment processors. By submitting payment information, you represent that you are authorized to use the payment method provided. We do not store full payment card details on our servers.
  • (d) Order ConfirmationReceipt of an order confirmation does not constitute acceptance of your order. We may verify information before acceptance, and acceptance occurs when we ship the product or activate the relevant service.

5. Shipping & Risk of Loss

Shipping timelines provided at checkout or in communications are estimates. Risk of loss and title pass to you upon delivery of the product to the carrier (or upon delivery to you where required by applicable consumer law). You are responsible for providing an accurate shipping address; we are not liable for losses resulting from incorrect address information you provide.

6. Returns & Refunds (Post-Launch Purchases)

Once products ship, return and refund eligibility will be set out in our published return policy at the time of purchase, in addition to any rights you have under applicable consumer protection law. Nothing in these Terms limits any non-waivable statutory rights you may have, including under the consumer protection legislation of your province or territory.

7. Limited Warranty

  • (a) CoverageThe Mulli Smart Grip is covered by a 2-year limited warranty from the date of purchase. During this period, we will repair or replace, at our option, any unit that fails to perform as intended under normal use.
  • (b) ExclusionsThis warranty does not cover: damage caused by misuse, abuse, accident, or neglect; unauthorized modification, disassembly, or repair; improper installation contrary to provided instructions; normal cosmetic wear; water or impact damage beyond the product's stated tolerances; or use with incompatible equipment or software.
  • (c) ProcessTo make a warranty claim, contact us with your proof of purchase and a description of the issue. We may require return of the unit for inspection. Replacement units may be new or refurbished and carry the remainder of the original warranty period.
  • (d) Statutory RightsThis limited warranty is in addition to, and does not limit, any legal warranties or rights you have under applicable law, including provincial consumer protection legislation.

8. App & Subscriptions

  • (a) Subscription PlansFull functionality of the Mulli system requires the companion App. Individual plans are billed at $25 CAD per month following any included free access period (reservations currently include 3 months of individual access). Coach plans start at $99 CAD per month. Pricing and plan features may change; changes will not apply retroactively to a prepaid period and will be communicated in advance of renewal.
  • (b) Billing & RenewalSubscriptions renew automatically until cancelled. You may cancel at any time, effective at the end of the current billing period. No partial-month refunds are provided unless required by law.
  • (c) AccountsYou are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.
  • (d) Service AvailabilityWe strive for high availability but do not guarantee uninterrupted access to the App or cloud services. Features may require a compatible smartphone, Bluetooth connectivity, and internet access, which are your responsibility.

9. Acceptable Use

You agree not to: reverse engineer, decompile, or extract source code, firmware, or sensor calibration data from any Mulli product or the App except as permitted by law; interfere with or disrupt the Site, App, or associated servers; use the Site or App for any unlawful purpose; scrape, harvest, or copy content or data from the Site or App without authorization; or misrepresent your affiliation with Mulli.

10. Intellectual Property — All Rights Reserved

All content on the Site and in the App — including but not limited to the Mulli name and logo, product designs, hardware and firmware, software, text, graphics, images, renders, videos, data visualizations, pressure mapping methods, and documentation — is the property of Mulli Swing Solutions or its licensors and is protected by Canadian and international copyright, trademark, patent, and other intellectual property laws. All rights reserved.

Purchasing a product or subscription grants you a limited, personal, non-exclusive, non-transferable licence to use the App and embedded firmware solely with your Mulli product for its intended purpose. No other rights are granted. You may not use our trademarks, branding, or content without prior written permission.

11. User Data & Privacy

Use of the Site and App involves the collection of personal information and swing/sensor data, which is handled in accordance with our Privacy Policy. By using our products and services, you consent to that collection and use as described there.

12. Product Use Disclaimer

The Mulli Smart Grip and App are training and feedback tools. They do not constitute professional coaching, medical, or health advice. You are responsible for using the product safely and within your physical capabilities. Consult a qualified professional before beginning any new training program if you have health concerns.

Competition use: It is your responsibility to confirm whether use of a sensor-equipped grip conforms to the equipment rules of any tournament, league, or governing body (including the Rules of Golf) in which you compete. Mulli makes no representation that the product is conforming equipment for sanctioned competition.

13. Disclaimer of Warranties

Except for the express limited warranty in Section 7 and any non-waivable statutory warranties, the Site, App, products, and services are provided "as is" and "as available," and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that sensor data will be error-free or that use of the product will improve your golf performance.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Mulli Swing Solutions, its directors, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or related to your use of the Site, App, or products. To the maximum extent permitted by law, our total aggregate liability for any claim shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the greatest extent permitted by law. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

15. Indemnification

You agree to indemnify and hold harmless Mulli Swing Solutions from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, App, or products, or your violation of any law or third-party rights.

16. Third-Party Links & Services

The Site or App may contain links to or integrations with third-party websites and services (including payment processors and app stores). We are not responsible for the content, policies, or practices of third parties, and your use of them is at your own risk and subject to their terms.

17. Governing Law & Disputes

These Terms are governed by the laws of the Province of New Brunswick and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Subject to any non-waivable consumer rights to bring proceedings in your home jurisdiction, you agree that the courts of New Brunswick have jurisdiction over disputes arising from these Terms. Before commencing formal proceedings, the parties agree to attempt in good faith to resolve any dispute informally by contacting us.

18. Force Majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including natural disasters, supply chain or manufacturing disruptions, carrier delays, labour disputes, governmental actions, or telecommunications failures.

19. General Provisions

Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.

No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

Entire Agreement. These Terms, together with our Privacy Policy and any order-specific terms, constitute the entire agreement between you and Mulli regarding their subject matter.
